Introduction

These product terms apply to any wiper products (products) purchased from Wiper Warehouse Pty Ltd ACN [639 901 956] (we, us, our). By purchasing a product from www.thewiperwarehouse.com.au, we agree to these product terms.

Products

We have developed a database that identifies products that may be used to replace the OEM windscreen wipers on your vehicle. There are often multiple model makes, which may impact the type of product that is appropriate for your vehicle. It is your responsibility to ensure you accurately populate the correct details of your vehicle (such as car, make and model) to ensure you receive the correct product.

Prices of each product are available on the website and are subject to change at any time. Prices are inclusive of GST but additional charges (such as shipping) may apply to your purchase where indicated on the website.

Purchases and delivery

Product purchases are subject to the following conditions:

• you are an adult and your delivery address is within domestic or rural routes covered by Australia Post;
• you provide us with current and accurate purchase and account information to process your purchase; and
• the product is available and not otherwise subject to any product limits or caps that we may impose from time to time.

We use Australia Post and rely on the information you provide to us to ensure your products are delivered promptly and in accordance with your instructions.

While we endeavour to ensure products are delivered to you promptly, we will not be responsible or liable:

• for any delay or interruption in the delivery of the products;
• for any delivery failure which is caused because you provided us with incorrect details; and
• for any loss, theft or damage to the product that occurs after the product is delivered to your nominated address.

Warranties

To the maximum extent permitted by law and subject to these terms, we exclude all express and implied warranties, including that the products will be fit for purpose or durable.

We provide a 12-month defect warranty on all our products. The warranty commences on the date the product is purchased from our website and is non-transferable (which means that it is only available to the person who purchases the product from us).

The warranty will cover defects in materials and/or workmanship of the product that are not otherwise excluded by these terms.

For example – the warranty would cover defects in materials and/or workmanship of the product – such as split or broken rubber or broken or damaged wiper blade connectors or end caps.

The warranty will not cover any issues that are caused or contributed by your conduct or fair wear and tear. This includes installing the product incorrectly or installing the product with unnecessary force or using inappropriate tools.

The warranty only applies to the product and does not extend to any other part or component of your vehicle. For example, even if the product is covered by warranty, any damage to your windscreen which arises from the faulty product will not be covered by the warranty.

You must comply with any reasonable direction we provide to enable us to assess whether you have an eligible warranty claim.

If you have an eligible warranty claim, we will at our absolute discretion either provide you with a replacement product or the relevant component of the product which is subject to the claim.

Refunds

We will provide you with a refund on any product purchased if:

the product has not been used;

the product is returned in the original packaging and otherwise in the same condition as it was when received;

you send the refunded product to us (at your cost);

the product is returned to us within 28 days after it was purchased; and

you provide us with proof of purchase of the product.

Limit of liability

To the maximum extent permitted by law, our liability to you in relation to any claim you may have against us in connection with these terms or any product is excluded. If our liability cannot be excluded by law and to the extent we are entitled to do so by law, our liability in respect of such claim is limited to, at our option, the re-supply of the relevant products (which are subject to the claim) or the payment of the cost of having those products supplied again.

In any event, we will not be liable to you in any circumstance for any consequential loss (which includes economic loss, loss of business opportunity, loss of profits or damage to property) you suffer or are otherwise entitled to in relation to any claim you have against us in respect of these terms or any product.

Miscellaneous

These terms are governed by the law of South Australia and you submit to the non-exclusive jurisdiction of the courts exercising jurisdiction in South Australia.

We can amend these terms at any time without providing you with notice of the variation.

If anything in these terms is unenforceable, illegal or void then it is severed from the terms and the remaining terms will remain in full force.
